I am making this post on behalf of my girlfriend whom right now is in a bit of a sticky spot with her current employer.
She is employed by a local spa which does laser hair removal for the most part.
Her and I are both worried by some of his more 'shady' business practices that he is carrying out in respect to pay, tax deductions, breach of the ESA (Employment Standards Act).
Here are some facts we have compiled:
-She is sometimes paid by cheque through a different company which her employer owns
-She has been working in excess of 100 hours every 2 weeks (on average 45-50 hours per week) and has yet to see any overtime pay
-She has been working there for a little under 3 months and was finally provided with a contract which outlines her employment terms and conditions last week
-There has been no 4% vacation pay on any of her cheques which would be fine if it was laid out in the contract when she would be paid the lump sum (paid out before she takes the 2 weeks vacation), it is not laid out in the contract
-Due to another employee leaving she has been stuck with long days (10-12 hours) which she is fully booked for giving no time for breaks (maybe 5 minutes when she can find the time between clients is all she receives)
-Her employer did not provide her with a TD1 tax form for tax deduction purposes and does not deduct any income tax from her pay
-Her employer offers to 'help' fill in the employees personal tax returns so they may make it seem as though they are self-employed and renting the clinic space from him to conduct business, he also offers to show them how to deduct their travel expenses, cellphone bills and internet bills from their personal income tax
-He has told her that he claims they are all self-employed and contracted out, the clients are those of the technicians (herself) and not the business (this was before the most recent contract which was given out last week)
We have come here to seek advice on our next course of action against these issues, we do not want any trouble for ourselves but we do not also want to see anyone become financially burdened by his personal financial choices. We have tossed up the ideas of filing a formal complaint with the Ministry of Labour and possibly calling the CRA Snitch Line.
